Acceptance and Scope.

Villa Enterprises Management Ltd, Inc. (“Villa Enterprises” or “We”) owns and/or operates various Websites, social media, and social media accounts and pages for the benefit of itself and other related and affiliated companies, including without limitation, Villa Companies (as that term is defined in the Terms of Service) (collectively, “Villa Websites”). Your use of Villa Websites, including without limitation, Villa Websites which link to this privacy policy (“Privacy Policy”), is conditioned on your agreeing to this Privacy Policy, If you do not agree to this Privacy Policy, do not use or access Villa Websites. The Villa Websites contain links to third-party websites which we do not own, operate or control. Accordingly, this Privacy Policy does not apply to any websites maintained or operated by third-parties. When you click on those links, you will go to a third-party website where you will be subject to that website’s privacy policy. Please be aware that we are not responsible for the privacy practices of those other websites, and we expressly disclaim any liability for their actions, including actions relating to the use and disclosure of Personal Information by those third-parties.

Collection of Information.

Villa Enterprises collects personally identifiable information (“Personal information”) when you fill out and submit forms such as feedback and comment forms or post on Villa Websites. Personal Information includes: Name, postal or billing address, e-mail address, telephone or mobile number, location via IP address, device being used (for our mobile site), cookies and similar technologies and other relevant data.

Use of your Information.

Whatever the purpose may be – whether we share with service providers or other external entities – we only process and share your Personal Information to the extent reasonably necessary to fulfill your requests and meet our legitimate business and legal objectives. When we disclose Personal Information to external entities, such as service providers, we establish by contract that they may access your Personal Information only for purposes of performing those services. We may disclose your information, however, when we determine it is necessary to comply with applicable laws, regulations or court orders or subpoenas, and we reserve the right to cooperate with requests from law enforcement agencies in providing information with regard to activities which we believe to be unlawful. Certain jurisdictions, including those in Europe, require the identification of the legal grounds for the collection, use, sharing and other processing of Personal Information. We rely on the following legal grounds for its collection, use, sharing and other processing of Personal Information as described in this Privacy Policy.

  • Necessary to provide information or otherwise carry out the performance of a contract with you as an individual;

  • Our legitimate business interests, including: Performance of contracts with service providers; Villa Company wide information sharing;

  • Customer relationship management and other forms of marketing and analytics;

  • Fraud prevention, misuse of company IT systems, or money laundering;

  • Whistleblower scheme operations;

  • Physical, IT and network perimeter security; and 

  • Internal investigations;

  • Compliance with legal obligations and/or defense against legal claims, including those in the area of labor law, social security and data protection, tax, and corporate compliance laws;

  • Protection of the vital interests of any individual;

  • Performant of a task carried out in the public interest or in the exercise of official authority invested in us; and 

  • Consent, as permitted by applicable law.

Promotional E-Mails.

If you do not want us to send you any e-mails promoting our merchandise, simply reply with “Remove” in the subject line of the e-mail, and we will not send you any more promotional e-mails without your permission. Also, you may remove yourself from our promotional mailing list by returning to our Web site and using our unsubscribe feature (Click the “Mailing List Link” enter your e-mail address, and the click the “Unsubscribe” button). In any event, we do not plan to send you more than four promotional e-mailings per year on items that we think may be of interest to you. We may, however, e-mail you to follow up on particular transactions, to make sure the products or services were received and that you were satisfied. We periodically review our security measures to evaluate industry best practices and update accordingly. Even so, despite our reasonable efforts, no security measure is ever perfect or impenetrable. The Websites are hosted by servers in the United States and we operate our business globally. Some countries may not provide the same level of data protection as your home country. If you are located for example, in European Economic Area or Switzerland (collectively, “Europe”), your Personal Information will be transferred to the United States, Europe and certain other non-US jurisdictions maintain local data protection regulations that confer certain data protection rights on individuals. We will address those rights where required by applicable laws. Note that if you are a franchisee or an employee of a franchisee, and we obtain access or otherwise process your Personal Information in that context, you should contact your employer/franchisee which will be in the best position to respond to your inquiry. If applicable, and you wish to exercise any of these rights, please contact us as set out below.

  • Right of Access. You have the right to obtain from us confirmation as to whether or not Personal Information concerning you is processed, and, to request access to the Personal Information. The access information includes, among other things, the purposes of the processing, the categories of Personal information concerned, and the recipients or categories of recipient to whom the Personal Information have been or will be disclosed. This is not; however, an absolute right and the interests of other individuals may restrict your right of access. You may have the right to obtain a copy of their Personal Information undergoing processing.

  •  Right to rectification. You have the right to obtain from us the rectification of inaccurate Personal Information about you. Depending on the purposes of the processing, you may have the right to have incomplete Personal Information completed, including by means of providing a supplementary statement.

  • Right to erasure (right to be forgotten). Under certain circumstances, you have the right to obtain from us the erasure of Personal Information concerning you, and we may be obligated to erase that Personal Information. Personal data may reside in backup archives that must be retained for a longer period of time, either because it is impractical to isolate individual data within the archive, or because it is required to be retained for contractual, legal, or compliance reasons. Personal Information will not be restored to production systems (except in certain rare circumstances, e.g., the need to recover from a natural disaster, etc.). In such cases, Personal Information may be restored from the backup, however, all necessary steps will be taken to honor the initial request and erase the primary instance of the data. Backup archives containing Personal Information is protected with strong encryption.

  • Right to restriction of processing. Under certain circumstances, you have the right to obtain from us restriction of processing your Personal Information. In that case, your data will be marked and may only be processed by us for certain limited purposes. As we process and use your Personal Information primarily for purposes of carrying out a contract for services relationship with us may have a legitimate interest for the processing which will override your restriction request, unless the restriction request relates to marketing activities.

  • Right to data portability. Under certain circumstances, you have the right to receive the Personal Information about you, which you have provided to us, in a structured, commonly used and machine-readable format, and you have the right to transmit that data to another entity without hindrance from us.

  • Right to object. Under certain circumstances, you have the right to object, on grounds relating to your particular situation, at any time to the processing of your Personal Information by us, and we can be required to no longer process your Personal Information.
    Where permitted by applicable law, you also have the right to lodge a complaint with a competent data protection supervisory authority.

Cookies.

Cookies are small pieces of information that we send to your computer. They are stored by your browser on your computer's hard drive to give you a unique identification. Each time you visit our site using your computer, the cookie allows us to recognize your computer as the one we delivered the cookie to. Our cookies contain only a numeric code, and do not contain any Personal Information about you. However, we have the capability to identify you based on the information provided by our cookies, and to correlate that information with your Personal Information. Cookies enable us to provide certain features, such as storing items in your shopping basket between visits, without losing any of the items in your shopping basket. Most web browsers automatically accept cookies, but you can usually change your browser to prevent that. Log Files

As with most other websites and web applications, we collect and use the data contained in log files. The information in the log files include your IP (Internet Protocol) address, your ISP (Internet Service Provider,), the browser you used to visit our site (such as Chrome or Internet Explorer or Firefox), the time you visited our site/applications and which pages you visited throughout our site/applications.

Cookies and Web Beacons.

We do use cookies to store information, such as your personal preferences when you visit our site. This could include only showing you a popup once in your visit, or the ability to login to some of our features, such as our web applications. You can choose to disable or selectively turn off our cookies or third-party cookies in your browser settings, or by managing preferences in programs Internet or network security programs such as Norton Internet Security or McAfee. However, this can affect how you are able to interact with Villa Websites as well as other Websites. This could include the inability to login to services or programs, such as logging into forums or accounts.

Deleting cookies.

This does not mean you are permanently opted out of any advertising program. Unless you have settings that disallow cookies, the next time you visit a Website running the advertisements, a new cookie will be added.

Surveys, Research and Promotions.

We may occasionally request that some customers and recipients voluntary complete surveys, which may be collected by an independent third party. Individual survey answers are confidential and data collected will be used to exclusively e-mail offers from us, and tailor promotional information which could be more directed toward your needs. You may choose to opt out of e-mails at any time by selecting “unsubscribe” from the bottom of any e-mail.

Children.

Villa Websites are not intended or directed to children under the age of 13, and we do not knowingly collect any Personal Information, or knowingly track the use of our Villa Websites from children. If we have actual knowledge that Personal Information about a child under 13 years old has been collected, then we will take the appropriate steps to delete such Personal Information. Villa Websites, and social media or social media accounts owned or operated by Villa Companies link to other Websites, but we are not responsible for how others use personally identifiable information.

Modification.

We reserve the right to modify this Privacy Policy at any time without notice. If we change our privacy practices, we will prominently post the modified policy on Villa Websites. If we are going to make any material change in the manner in which we collect, use, disclose or otherwise process Personal Information, we will prominently post an updated Privacy Policy on our Villa Websites. Any material change to this Privacy Policy will be effective 10 days after our posting of the updated Privacy Policy. Where required to do so by law, we may seek your prior consent to any material changes we make to this Privacy Policy. Your continued use of Villa Websites following the posting of changes will mean you accept those changes.

California Privacy Rights.

Under California law, California residents have the right to request in writing from businesses with whom they have an established business relationship: (a) a list of categories of personal information, such as name, address, e-mail address, and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates or related companies that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes, and (b) the names and addresses of all such third parties.
